MWM Law LLC is devoted to representing Taft-Hartley, jointly-trusteed, multiemployer plans governed by ERISA. These include pension, annuity, welfare, apprenticeship, and other benefit funds on matters including:  

• Drafting and amending trust and plan documents.
• Research and analytical work in collaboration with co-counsel,  actuaries, auditors, and welfare consultants.
• Negotiate with insurance companies and other service providers.
• Provide representation in fund mergers and reorganizations.
• Benefit claims and QDRO processing. 

The firm provides a full range of litigation services that includes:

• Pursuing contribution collections and creditor bankruptcy claims.
• Represent and advise plans on claims and appeals issues.
• Represent plans and trustees in claims and fiduciary litigation, including ERISA fiduciary actions to recover plan assets and defending fiduciary claims. 
• Enforce Fund rights under collective bargaining agreements.
• Withdrawal liability collection, including successor liability and evade or avoid transactions.
• Serve as local counsel or co-counsel in ERISA-related matters.

 MWM Law LLC works with its representative plans to ensure ongoing tax qualified status and advise trustees on changes to laws and regulations that affect plan administration and participants. This counsel includes:

• Analyze investment-related documents and negotiate complex private investment side letters.
• Consider tax and regulatory consequences of cross-border and offshore investments, including tax treaty issues, FATCA, and CRS requirements.
• Monitor ongoing rulemaking by DOL, IRS, HHS, and PBGC affecting plan benefits, investments, cybersecurity, and funding.
• Represent plans in regulatory matters, including preparing comments on proposed regulations.
